Enrollment:

 

Lab Junior reserves the right to cancel or postpone scheduled courses, depending on enrollment.  If a course is canceled, parents will be refunded all associated registration fees.

Late Pickup Fees (In-Person Only):

At the end of a course, please pick up your child promptly.  A 10-minute grace period is given for any unexpected problems.  After the 10-minute grace period, a charge of $5 per 5-minutes late (for each child) will be assessed to the parent when the students are not picked up on time after class.  Late pick-up fees are due at pick up. Cash is accepted.

Student Conduct:

Students have the responsibility to follow the rules and regulations of Lab Junior, and to cooperate with the Lab Junior instructor(s).  This includes not browsing to 3rd party web-sites, as well as treating other students with kindness and respect.  Students not adhering to this conduct policy shall be removed from course, and no refund shall be issued.

Makeup Classes:

Makeup classes are not offered to students who miss one or more class meetings.

Special Medical Care and Arrangements (In-Person Only):

Please notify Lab Junior in writing and before the first day of the course, if your child requires any special medical care or has particular medical needs.  Lab Junior instructors are NOT trained in any medical capacity and NOT responsible for administering medical care or treatment of any kind.

Allergies (In-Person Only)::

Please notify Lab Junior in writing and before the first day of a course, if your child has allergies to anything.  The Lab Junior instructors are NOT trained in any medical capacity and NOT responsible for administering medical care or treatment of any kind.

Health and Safety Protocols (In-Person Only):

AI Lab Junior reserves the right to modify its health and safety protocols at any time in order to adapt to changing environments and/or recommendations.

Parent Medical Consent (In-Person Only):

By accepting these terms and conditions, you, being the lawful parent and/or guardian of the child registered with a course of Lab Junior, hereby consent to the participation by child in all Lab Junior activities and events.  Parent/Guardian further acknowledges that Lab Junior instructors or agents are not trained medical professionals, and as such, in the event Parent/Guardian entrusts Lab Junior with any medical instructions pertaining to the child, Parent/Guardian and child waive to the fullest extent of the law all rights, claims and actions against Lab Junior resulting from such medical instructions.  Further, Parent/Guardian and child assume all risk of injury or harm to child associated with child’s participation in any class, or any resulting treatment administered by any Lab Junior agent requested by Parent/Guardian, and Parent/Guardian and child hereby release, indemnify, defend and forever discharge Lab Junior and its instructors and agents or and from all liability, claims, demands, damages, costs, expenses, actions and causes of action in respect of death, injury, loss or damage to the child, however caused, arising out of or by reason of or during child’s participation with AI Lab Junior.

Non-refundable deposits and payments:

All payments made to Lab Junior are non-refundable.

No Transportation at the End of Class (In-Person Only):

Lab Junior shall not coordinate or facilitate the transportation of any child at the conclusion of any Lab Junior course.  Further, in no event will Lab Junior, or any of its affiliates, licensors, employees, agents, owners, officers or directors be liable to you for damages of any kind arising out of or in connection with the transportation of your child at the end of any class, including any direct, indirect, special, incidental, consequential or punitive damages, whether such damages arise under contract, tort (including negligence or strict liability), or any other legal theory, and even if such damages are foreseeable.  Parent/Guardian and child assume all risk of injury or harm to child associated with child’s transportation from any Lab Junior class .  Parent/Guardian and child hereby release, indemnify, defend and forever discharge Lab Junior and its staff, employees and agents or and from all liability, claims, demands, damages, costs, expenses, actions and causes of action in respect of death, injury, loss or damage to the child, however caused, arising out of or by reason of or during child’s transportation from any Lab Junior class.

Limitation of Liability:

EXCEPT TO THE EXTENT THAT DISCLAIMER OF LIABILITY IS PROHIBITED UNDER APPLICABLE LAW, IN NO EVENT WILL LAB JUNIOR , OR ANY OF ITS  AFFILIATES, LICENSORS, EMPLOYEES, AGENTS, OWNERS, OFFICERS OR DIRECTORS BE LIABLE TO YOU FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR CHILD’S PARTICIPATION IN ANY AI LAB JUNIOR CLASS, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES  WHETHER SUCH DAMAGES ARISE UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), OR ANY OTHER LEGAL THEORY, AND EVEN IF SUCH DAMAGES ARE FORESEEABLE. IF, UNDER APPLICABLE LAW, LIABILITY FOR DIRECT DAMAGES CANNOT BE EXCLUDED (NOTWITHSTANDING THE FOREGOING), THEN THE TOTAL CUMULATIVE LIABILITY OF AI LAB JUNIOR (OR ANY OTHER PERSON) IN CONNECTION WITH THIS AGREEMENT, WHETHER IN CONTRACT, IN TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE GREATER OF US $5.00 OR THE AMOUNT OF FEES (IF ANY) THAT YOU PAID TO LAB JUNIOR FOR PARTICIPATION IN THE RELEVANT CLASS GIVING RISE TO LIABILITY. THE EXISTENCE OF MULTIPLE CLAIMS WILL  NOT EXPAND THIS LIMIT.  YOU ACKNOWLEDGE THAT THE FEES REFLECT THE ALLOCATION OF RISK SET FORTH IN THIS AGREEMENT AND THAT LAB JUNIOR WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS ON ITS LIABILITY.  THE LIMITATIONS AND  EXCLUSIONS  OF  LIABILITY  IN  THIS SECTION WILL APPLY EVEN IF AN EXCLUSIVE REMEDY UNDER THIS AGREEMENT HAS FAILED OF ITS ESSENTIAL PURPOSE.

Choice of Law and Venue:

This Agreement will be governed by the laws of the State of Maryland without giving effect to any choice of law principles that would require the application of the laws of a different country or state. Any legal action between You and Lab Junior arising out of these Terms and Conditions or your child’s participation in any class or camp must be instituted exclusively in the federal or state courts located in the state of Maryland, and You consent to jurisdiction and venue in such courts.
